These Terms and Conditions ("Terms") apply to your use of the Primos Grecos online shop and to purchases made through it. The shop is operated by Primos Grecos LLC, doing business as Primos Grecos ("Primos Grecos," "we," "us," or "our"). By using the shop or placing an order, you agree to these Terms, as well as our posted Shipping, Returns and Privacy Policies.

1. Eligibility

You must be at least 18 years old, or have the permission and supervision of a parent or legal guardian, to place an order. You may use the shop only for lawful purposes and may not interfere with its operation, attempt fraud, or misuse our content or services.

2. Products and Information

We work to describe and photograph our products accurately. Because packaging, labeling, ingredients, suppliers, and product appearance may be updated from time to time, minor variations may occur. The label and packaging delivered with the product contain the most current product information and should be reviewed before use.

Our seasonings are food products. Please read the product description, ingredient statement, allergen information, and package label before purchasing or consuming a product. If you have a food allergy, sensitivity, dietary restriction, or medical concern, consult an appropriate healthcare professional before use. Do not use a product if its safety seal is missing or damaged. Our products and shop content are not medical advice and are not intended to diagnose, treat, cure, or prevent any disease.

3. Orders and Acceptance

Submitting an order is an offer to purchase. An automated order confirmation acknowledges receipt but does not guarantee acceptance. We may refuse, limit, or cancel an order for legitimate reasons, including suspected fraud, payment problems, inventory errors, shipping restrictions, resale activity, violations of these Terms, or an obvious pricing or product-description error.

If we cancel an order after payment, we will refund the amount charged for the canceled item or order to the original payment method. We may also contact you to verify order or shipping information before accepting or fulfilling an order.

4. Prices, Payments, Promotions, and Taxes

Prices are shown in U.S. dollars unless stated otherwise and may change without notice. The price charged is the price shown at checkout when the order is submitted, except in the case of an obvious error. Shipping charges and applicable taxes are shown at checkout when available.

Payment must be authorized through the payment methods offered at checkout. Discounts, promotional codes, and special offers may have separate conditions, cannot be combined unless stated otherwise, and may be changed or ended at any time. They have no cash value and cannot be applied retroactively.

5. Shipping and Delivery

Shipping destinations, rates, processing estimates, and delivery information are governed by our posted Shipping Policy. Processing and delivery dates are estimates, not guarantees. Delays may occur because of carriers, weather, peak demand, incorrect addresses, supply interruptions, or other circumstances outside our reasonable control.

Customers are responsible for providing a complete and accurate delivery address. If an order is returned because the address provided was incorrect or incomplete, additional shipping charges may apply before it is resent. If tracking shows a package as lost, damaged, or delivered but you cannot locate it, contact us promptly at primosgrecos@gmail.com so we can review the issue and assist with the carrier. Nothing in this section limits rights that cannot legally be limited.

6. Returns, Refunds, and Damaged Orders

Returns, exchanges, refunds, and reports of damaged or incorrect items are governed by our posted Returns Policy. Because our products are consumable food items, opened products generally cannot be returned or resold unless they are defective, damaged, incorrect, or applicable law requires otherwise. Your rights under applicable consumer-protection law are not limited by these Terms.

7. Product Use and Storage

You are responsible for using and storing products according to their labels and any instructions supplied with them. Products are intended for ordinary culinary use. We are not responsible for harm caused by use contrary to the label or instructions, improper storage, product alteration, or use after the product has spoiled or passed any stated date, except where responsibility cannot legally be excluded.

8. Personal Use and Resale

Retail purchases are intended for personal or household use. You may not reproduce, repackage, relabel, modify, or resell our products or represent yourself as an authorized Primos Grecos distributor without our prior written permission. 9. Intellectual Property

The Primos Grecos name, product names, logos, packaging, photographs, graphics, recipes, written copy, and other shop content are owned by or licensed to us and are protected by applicable intellectual-property laws. You may view the shop and share links for personal, noncommercial purposes. You may not copy, publish, sell, modify, scrape, or use our content, branding, or product presentation for commercial purposes without prior written permission.

10. Third-Party Services and Links

Our shop may rely on or link to services provided by Big Cartel, payment processors, carriers, social platforms, and other third parties. Those services may have their own terms and privacy practices. We are not responsible for third-party sites or services that we do not control, but this does not affect our obligations to you as the seller of your order.

11. Disclaimer of Warranties

To the fullest extent permitted by law, the shop and its content are provided on an "as available" basis. We do not promise that the shop will always be uninterrupted, error-free, or free from harmful components. Except for warranties expressly stated by us or required by law, we disclaim other express or implied warranties. Some jurisdictions do not allow certain warranty exclusions, so these exclusions may not apply to you.

12. Limitation of Liability

To the fullest extent permitted by law, Primos Grecos and Primos Grecos LLC  will not be liable for indirect, incidental, special, consequential, or punitive damages arising from the shop or an order. For claims that may legally be limited, our total liability will not exceed the amount you paid for the product or order giving rise to the claim.

Nothing in these Terms excludes or limits liability for fraud, willful misconduct, personal injury caused by negligence, breach of a legal obligation that cannot be limited, or any other liability that applicable law does not permit us to exclude or limit.

13. Events Outside Our Control

We are not responsible for delay or failure caused by events outside our reasonable control, including severe weather, natural disasters, fire, public-health emergencies, labor disruptions, carrier interruptions, government action, power or internet outages, supply shortages, or failures of third-party services. We will make reasonable efforts to communicate material delays and fulfill or refund affected orders as appropriate.

14. Governing Law and Disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules, except that mandatory consumer protections in your place of residence continue to apply. Before filing a claim, you and Primos Grecos agree to make a good-faith effort to resolve the issue by contacting the other party and allowing 30 days for a response. If the issue is not resolved, disputes may be brought in the state or federal courts located in San Mateo County, State of California, unless applicable law gives you the right to bring a claim elsewhere. Either party may bring an eligible claim in small-claims court.

15. Changes to These Terms

We may update these Terms as the shop, products, or law changes. Updated Terms will be posted with a new effective date and apply prospectively. The Terms in effect when you place an order will govern that order unless a change is required by law.

16. Severability and Entire Agreement

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect, and the unenforceable provision will be interpreted as closely as possible to its intended purpose. These Terms and the policies referenced above form the entire agreement between you and us regarding use of the shop and retail purchases, except for any additional written terms that expressly apply to a particular transaction.
